According to this document describing the Law, artificial intelligence systems are divided into open, closed, and local, depending on their mode of use.
Open AI systems are systems whose architecture and parameters are available for free use, modification, and distribution in accordance with the terms of the user agreement.
Closed artificial intelligence systems are systems whose architecture and parameters are restricted by their owner or proprietor.
In this case, users must be informed that the goods, works, and services are produced or provided using artificial intelligence systems.
The distribution of synthetic results of AI systems is permitted only if they are labeled in a machine-readable form and accompanied by a visual or other form of warning that allows the user to perceive them without the use of methods that hinder such perception.
It should be noted that machine-readable forms allow information to be recorded and recognized automatically. Failure to comply with this requirement is punishable by fines, which are specified in the Code of Administrative Offenses of the Republic of Kazakhstan.
In particular, for individuals, the fine is 15 MCI or 64,875 tenge, for small businesses and non-profit organizations — 20 MCI or 86,500 tenge, for medium-sized businesses — 30 MCI or 129,750 tenge, and for large businesses — 100 MCI or 432,500 tenge. In case of repeated violations within a year, fines may be increased.
In the event of repeated violations, large companies may have their AI systems temporarily suspended or completely banned.
